Terms & Conditions – TCL Kenya

Welcome to TCL Kenya (tclkenya.ke). By accessing or using our website, placing an order, or visiting our physical showroom, you agree to be bound by the following Terms & Conditions. Please read them carefully.
1. About Us
TCL Kenya is the authorized TCL dealer in Kenya, operating under:

Our website sells genuine TCL products including televisions, refrigerators, air conditioners, washing machines, audio systems, and accessories.
2. Eligibility to Use
By using this site, you confirm that you:
Are at least 18 years old or have parental/guardian consent.
Are a resident of Kenya with a valid delivery address (we do not ship internationally).
Will provide accurate, current, and complete information during checkout.
We reserve the right to refuse service or cancel orders if we suspect fraudulent activity or violation of these terms.
3. Products & Pricing
Product descriptions: We strive for accuracy, but we do not warrant that product descriptions, specifications, images, or colours are error‑free. If a product is not as described, your remedy is to return it under our Returns & Refund Policy.
Pricing: All prices are in Kenyan Shillings (KSh) and include VAT (where applicable). Prices are subject to change without notice. However, once you place an order, the price is locked at checkout.
Typographical errors: In the event of a clear pricing error (e.g., KSh 500 for a KSh 50,000 TV), we reserve the right to cancel the order and refund you fully.
Availability: Stock levels are updated regularly, but high demand may cause an item to go out of stock after you order. If so, we will contact you to offer a replacement, backorder, or full refund.
4. Orders & Acceptance
Order confirmation: After you place an order, you will receive an email/SMS acknowledging receipt. This is not an acceptance of your order.
Order acceptance: A binding contract is formed only when we dispatch the product and send a dispatch confirmation. We may cancel any order before dispatch for any reason (e.g., stock unavailability, pricing error, suspected fraud).
Right to cancel: You may cancel within 2 hours of placing the order (see Returns & Refund Policy). After dispatch, the standard returns process applies.
5. Payment Methods
We accept:
M-Pesa (Lipa Na M-Pesa – Paybill number provided at checkout)
Bank transfer (details on request or at checkout)
Cash on delivery (COD) – available for selected areas only (additional fee may apply)
Card payments – in‑store only (not online at present)
Payment security: We do not store your M-Pesa or card details. All transactions are encrypted. For COD, you pay the courier directly – never send cash via unofficial channels.
Payment deadlines: For bank transfers, you must complete payment within 24 hours of order placement; otherwise the order is cancelled.
6. Shipping & Delivery
Delivery is subject to our Shipping & Delivery Policy (see separate page). Key points:
Estimated delivery times are not guaranteed but we strive to meet them.
Risk of loss or damage passes to you upon delivery. However, if the package is damaged on arrival, do not accept it and contact us immediately.
We are not liable for delays caused by courier issues, weather, strikes, or events beyond our control.
7. Returns, Refunds & Warranty
All returns, refunds, and warranty claims are governed by our:
Returns & Refund Policy (14 days for change of mind, restocking fee, etc.)
Warranty Policy (2 years for TVs, 2+ years for major appliances)
We do not offer refunds for change of mind after 14 days, nor for opened/used products unless defective.
8. User Accounts
You may create an account to track orders, save addresses, and view history. You are responsible for:
Maintaining confidentiality of your login credentials.
All activities that occur under your account.
Notifying us immediately of any unauthorised use.
We reserve the right to suspend or delete accounts that violate these terms.
9. Prohibited Activities
You may not use our website for:
Any unlawful purpose.
Transmitting malware, viruses, or harmful code.
Scraping, data mining, or copying content without permission.
Interfering with the site’s security or performance.
Violation may result in legal action and a ban from our site.
10. Intellectual Property
All content on tclkenya.ke (text, images, logos, product photos, graphics) is owned by TCL Kenya or licensed from TCL Corporation. You may not reproduce, distribute, or exploit any content without prior written consent. “TCL” and the TCL logo are registered trademarks.
11. Limitation of Liability
To the maximum extent permitted by Kenyan law:
Our total liability for any claim arising from your purchase or use of the site shall not exceed the price you paid for the product in question.
We are not liable for indirect, incidental, or consequential damages (e.g., loss of profits, data, or use).
Nothing in these terms excludes liability for death, personal injury, or fraud.
12. Indemnification
You agree to indemnify and hold TCL Kenya harmless from any claims, damages, or expenses arising from your violation of these terms or misuse of the site.
13. Third‑Party Links
Our website may link to external sites (e.g., TCL global, payment gateways). We are not responsible for their content or practices. Use them at your own risk.
14. Privacy & Data Protection
Your use of the site is also governed by our Privacy Policy, which complies with Kenya’s Data Protection Act. By using our site, you consent to the collection and use of your data as described therein.
15. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to: natural disasters, war, strikes, government orders, power outages, or courier disruptions.
16. Changes to Terms
We may update these Terms & Conditions at any time. Changes become effective when posted on this page. The “Last Updated” date will be revised. Continued use of the site after changes constitutes acceptance.
17. Governing Law & Dispute Resolution
These Terms & Conditions are governed by the laws of Kenya. Any dispute arising shall first be attempted to be resolved through good‑faith negotiations. If unresolved, disputes shall be submitted to the High Court of Kenya, Nairobi, or through arbitration as per the Arbitration Act of Kenya.
